1. DESCRIPTION OF THE PROMOTION
The promotion entitled "One Dress; One Cruise" (hereinafter "Promo") is sponsored by Traka in the Night SL with CIF B01750298 and address at Carrer Aragó 399, 08013 Barcelona (hereinafter "Sponsor"), and supplied by Incentivos de Ventas PromoViaje S.L. (hereinafter "PromoViaje S.L."), (hereinafter "Supplying Company" or "Promoviajes") and brides who have purchased a wedding dress of the brand "Lili Pellegrino" at any of the points of sale participating in the promotion may participate.
The promotion will run from May 7, 2023 to August 31, 2023, and will be available while supplies last. Units are limited. The order of awarding will depend on the date of registration for the reservation and the formalization of the purchase.
2. OBLIGATION OF PURCHASE
It is necessary to purchase a wedding dress of the brand "Lili Pellegrino" in any of the international points of sale assigned to the promotion. It will be mandatory to submit the receipt or invoice to confirm the purchase. This information will be contrasted with the point of sale.
3. ELIGIBILITY
Only brides who purchase a "Lili Pellegrino" brand wedding dress at any of the international points of sale participating in the promotion are eligible to participate in this promotion.
4. ACCEPTANCE OF OFFICIAL RULES
Participation in this Promotion constitutes full and unconditional acceptance of these Official Rules and the decisions of Sponsor, which are final, binding and in Sponsor's sole discretion on all matters relating to this Promotion. Winning a prize, as described below, is subject to compliance with all requirements set forth herein.
5. HOW TO PARTICIPATE
To participate you must:
1. Fill in the form with all the required data to book the promotion.
2. Book and attend an appointment at a point of sale attached to the promotion.
3. Choose your Lili Pellegrino wedding dress.
4. Formalize the purchase.
5. Access the terms and conditions confirmation form and send all the requested information.
6. DELIVERY OF THE PRIZE AND VALIDITY OF THE PRIZE
The prize will be delivered by mail to the address provided by the client. The term of shipment and reception can be extended up to 15 working days.
The prize will be valid and can be redeemed with the supplier until April 2024.
7. THE PRIZE
- A Mediterranean Cruise Voucher for two people.
No prize is transferable or exchangeable. No cash prizes will be awarded.
The prize will be awarded once the conditions of the promotion have been verified.
7.1. SUPPLIER'S CRUISE CONDITIONS
The following are the terms and conditions set by the agency that manages the cruise vouchers:
Depending on availability, you can choose between cruises of 4 days and 3 nights, 5 days and 4 nights, 6 days and 5 nights or 8 days and 7 nights, for 2 persons, full board (breakfast, snack, dinner, lunch and midnight snack), cabin in interior cabin category with daily cleaning and uncovering of bed, unlimited access and use of the facilities in gym, swimming pools, library, discotheque, theater... and participation in all programs and entertainment activities.
Excluded are the promotion taxes, beverages (which can be optionally contracted through our reservation service), management fees, excursions in the stops made in the cities, transfer to the seaport and tips, which must be paid by the user on board, these being variable. You will be informed of these during the booking process.
7.1.2. MAKING A RESERVATION
Booking dates:
The cruise is subject to availability and may exclude high season, long weekends and holidays.
Validity of the promotion:
The expiration date of the promotion is the date shown on the promotion.
How to book:
Step 1: Access the website www.promoviaje.es
Step 2: Enter the booking code that appears on the promo trip.
Once the two previous steps have been completed, you can request information and proceed to book your cruise through the website, by phone or email.
The client will have to pay the indicated costs, as well as the extras requested by bank transfer to the number that will be indicated at the moment of the reservation within 24 hours from the reception of the quotation.
The last step, thus closing the management and reservation, will be the sending of the boarding card together with the indications that you must know to carry out your cruise.
7.1.4. PAYMENTS.
- At the moment of the acceptance of the conditions offered to the user for his cruise, the full payment of the costs of the promotion, as well as the extra expenses that are contracted as alternative routes that carry the corresponding additional supplements of the cruise, must be paid for the confirmation of the reservation. The totality of the price must be paid at the moment of the contracting, by means of a unique payment.
If the payment of the reservation is not satisfied, it will be null and void and will not have the character of a reservation until the payment is made, which will have to be communicated by sending the receipt of the transfer or deposit to the email info@promoviaje.es
. To make the payment of the reservation of the offer offered by Promoviaje must be with a maximum period of 24 hours, since the availability of the places could change and if we exceed this time could disappear this availability for your reservation, not assuming Promoviaje or our partner agency any responsibility in this regard, making the refund of the amount made by the user.
- Failure to pay the aforementioned amounts on the established dates will constitute a breach of contract and will result in the application of penalties for cancellation.
- The passenger ticket and the receipts corresponding to the other services agreed upon, which constitute the legitimizing titles for access on board and to obtain the provision of the aforementioned services, as well as the rest of the definitive documentation of the trip, will be delivered to the passenger once the total balance of the price has been paid.
- Payments made by the user will be considered made only when they have been received by Promoviaje.
7.1.3. RESERVATIONS.
Our collaborating travel agency and promoviaje, abide by the legal and general conditions of the shipping companies, with which it distributes its products, being the shipping companies the ones that have the legal authority and final responsibility over the cruises and the passengers that travel.
The responsibility of our collaborating agency ends when the reservation management is completed, ending the process and work, with the issuance and delivery of the cruise tickets to the user.
7.1.5. EXPENSES.
- 4 days and 3 nights Inside Stateroom Cruises:
195 € promotion fee per person.
30 € handling fee per person.
- 5 days and 4 nights Inside Stateroom Cruises:
245 € promotion fee per person.
30 € handling fee per person.
For each extra day, 50 € per day and person will be added.
Consult prices for other types of cabins.
7.1.6. MODIFICATIONS TO THE TRIP.
If before the departure of the trip, the Organizer is forced to significantly modify any essential element of the contract, it will immediately inform the passenger. Significant modifications of essential elements of the contract, as set out in these conditions, shall not be considered significant:
- Modification of airlines, flight schedules and routes, as long as the departure and arrival dates remain unchanged and the embarkation and disembarkation of the ship is allowed on the dates scheduled for the cruise. (Only for those who choose an additional itinerary other than the departures of the current promotion).
- Replacement of the vessel.
- Modification of the cruise route
- The assignment of another cabin
- Variations in the scheduling of shows and other forms of entertainment on board ship.
The Organizer has the right to substitute the planned boat for another of similar characteristics, if necessary for technical, operational or other reasonable reasons.
7.1.7. CANCELLATION OF THE CONTRACT BY THE TRAVELER.
- The passenger may cancel the contract without penalty only when he/she is informed of the modification of an essential element, in which case he/she will be entitled, alternatively, to enjoy another package, or to the reimbursement of the part of the price already paid at the time of the cancellation. The package that the traveler chooses to take advantage of must be of equivalent or greater value than the one originally planned. If the Organizer is unable to offer a package of equivalent or higher value, the passenger shall be entitled to reimbursement of the difference.
- At any time the user or consumer may cancel the services requested or contracted, having the right to a refund of the amounts paid before confirmation, whether it is the total price or the advance payment provided in the preceding paragraph, but must compensate Incentivos de Ventas Promoviaje, for the concepts indicated below:
a) In the case of single services: The total management costs, plus cancellation fees, if the latter had occurred.
b) The combined cruise trip is subject to special economic conditions of contracting that require significant forecasts, freight, provisioning of ships and special air fares, so that the passenger who withdraws from the contract for reasons other than those provided for in the preceding paragraph will be charged the management fees, the registration fee if provided and, as cancellation and penalty fees, the amounts indicated below:
The full amount paid within 24 hours of confirming your reservation, if you have taken out the optional cancellation insurance and your cause is justified within the coverage of the policy, the amount will be refunded, except the cost of the insurance.
In case of no-show at the departure, the consumer and user is obliged to pay the total amount of the trip, contributing, where appropriate, the outstanding amounts unless otherwise agreed between the parties.
- In cases of hiring the optional travel insurance, the amount of the premium will be paid by the passenger in any case, even if he/she cancels the trip before departure, because the coverage included in the policy includes risks prior to the start of the trip.
7.1.8. ASSIGNMENTS.
- The principal contracting party or the passenger may assign his/her reservation for the contracted trip to another person who meets all the conditions required for the trip once he/she has paid for the reservation (passport, visas, health certificates, etc.) upon payment of the assignment fee (60 € if flights are not included).
- The assignment must be communicated in writing to Promoviaje and to our collaborating agency at least 15 days prior to the date of the start of the trip. The transferor and the transferee of the trip will be jointly and severally liable, before the Collaborating Agency and the Organizer, for the payment of the balance of the outstanding price, as well as the justified additional expenses that the transfer may have caused.
- In view of the price bonuses obtained in your promotion, any substitution will imply the cancellation of the reservation, and the making of a new one with the existing conditions at that moment according to your request.
- The cruise ticket is transferable only in case of transfer of the package travel contract, as indicated in the preceding paragraphs.
7.1.9. CANCELLATION.
Some of the destinations may be cancelled without prior notice for reasons of force majeure, as well as changing the itinerary or planned stops.
The destinations are subject to existing availability, and the customer cannot demand a specific date or a specific destination.
7.1.10. PASSENGER OBLIGATIONS.
The passenger must carry an individual passport and/or other valid documents for all countries included in the itinerary of the trip, as well as entry and transit visas and health certificates that may be required. All this depending on the nationality of the passengers.
For the enjoyment of your promotion may be required all kinds of legal, medical or other documentation, as deemed by the shipping company or our partner agency to ensure the quality of the travel program and the safety guarantees of users.
7.1.11. APPLICABLE JURISDICTION
The applicable jurisdiction for this promotion and the Legal terms thereof shall be governed by the law of Spain and the courts and tribunals of Alicante shall have exclusive jurisdiction in relation to any dispute between the parties.
7.1.12. EXCLUSION PERIODS:
Exclusion periods may apply during long weekends, holidays and high shipping season.
8. DISCLAIMER
Traka in the Night SL guarantees the payment to the company supplying the cruise voucher the value of the same for the customer to enjoy the cruise. Traka in the Night SL is not responsible for any inconvenience caused by the supplier.
